Legality of using refused patches?

Guys,

I found a patch via Google that was rejected by DHH sometime ago, submitted by a James Adam from AEMedia.com. The patch, in it’s entirety, appears below. I’d like to use it. I will likely have to modify a few things to make it work in newer Rails.

This brings up a good question…if a patch were accepted, it would be licensed along with Rails. BUT, because it was rejected, what are the legal implications of using it?

Contributing a patch implies that the author is willing to have that code licenses under the terms of the license the project to which he is contributing uses.

I don't know if that would stand up in court (ask a lawyer, not a mailing list ;)) but I imagine it's safe to use.
